4. Contract Text and Contract Language
The Seller stores the contract text and makes it available to the customer in text form (e.g., by email or printed together with the delivery of the order).
Before placing the order, the customer may print the contract text using the print function of their browser or save it using the webpage saving function.
The contract language is German; contracts may be concluded in this language.
5. Information on Prices and Shipping Costs
Unless otherwise stated, all prices are total prices including the applicable statutory value-added tax (VAT).
6. Payment Methods and Payment Terms
When using financial institutions and other payment service providers, their respective terms and conditions and data protection notices shall additionally apply. Customers are requested to observe these provisions and information during the payment process. This applies in particular because the availability of payment methods or the payment procedure may depend on agreements between the customer and financial institutions or payment service providers (e.g., spending limits, location-based restrictions, verification procedures, etc.).
The customer shall ensure that they meet all requirements necessary for successful payment using the selected payment method. This includes, in particular, sufficient funds in bank or other payment accounts, registration, identification, and authorization with payment services, as well as confirmation of transactions.
The Seller reserves the right to offer payment methods only up to or from a certain order value. In such cases, the Seller will inform the customer of any payment restrictions before the start of the ordering process. The right of consumers to use a free, common, and reasonable means of payment shall not be restricted.
Advance Payment – If payment in advance by bank transfer has been agreed, the payment amount is due upon conclusion of the contract, unless otherwise agreed. The Seller will provide the customer with bank details. Delivery takes place after receipt of payment. If payment is not received within 10 calendar days after dispatch of the order confirmation despite a reminder, the Seller may withdraw from the contract, with the result that the order becomes void and the Seller is no longer obliged to deliver. The order is then settled without further consequences for both parties.
Credit Card Payment – By placing the order, the customer provides their credit card details. The credit card will be charged immediately after completion of the order and authorization of the customer as the legitimate cardholder.
PayPal – Payment is processed via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg, using the method selected by the customer. Customers are redirected to PayPal at the end of the ordering process. The PayPal terms of use apply.
PayPal Plus (PayPal) – The customer must have a PayPal account and completes the payment using the PayPal transaction process.
PayPal Plus (Credit Card) – The customer may pay via credit card through PayPal even without a PayPal account. The customer must identify themselves as the legitimate cardholder before the transaction is processed.
Costs arising from reminders of due payments will be charged to the customer. The customer reserves the right to prove that no or lower costs were incurred.
In the event of default in payment, the Seller is entitled to charge statutory default interest and claim further damages and costs permitted by law, including legal enforcement costs.
7. Retention of Title
For customers who are entrepreneurs, the following applies: the delivered goods remain the property of the Seller until full payment has been made (hereinafter referred to as “reserved goods”).
The Seller retains ownership until all claims arising from the business relationship have been fully settled. The customer is obliged to treat the reserved goods with care. In particular, the customer must insure them adequately at their own expense against theft, fire, and water damage at replacement value where customary.
Processing or transformation of the reserved goods is carried out on behalf of the Seller. If combined with third-party goods, the Seller acquires co-ownership proportionate to the value.
Claims arising from resale are assigned in full to the Seller as security. The Seller may revoke authorization to collect such claims if the customer fails to meet payment obligations.
The Seller shall release securities upon request if their realizable value exceeds outstanding claims by more than 10% (or 50% in case of realization risk).
8. Delivery, Availability of Goods
Delivery by freight carrier requires that the conditions specified during the ordering process are met.
If collection by the customer is agreed, the Seller will inform the customer when the goods are ready for collection. No shipping costs apply unless otherwise agreed.
If delivery fails due to the fault of the customer after three attempts, the Seller may withdraw from the contract.
If goods are unavailable due to non-delivery by suppliers without fault of the Seller, the Seller may withdraw from the contract and inform the customer immediately.
For entrepreneurs, the risk passes to the customer upon handover to the carrier.
9. Digital Services
“Digital services” exist when they enable consumers to create, process, store, or access digital data or interact with such data.
These GTC apply accordingly to digital services.
10. Production and Processing According to Customer Specifications
If the contract provides that goods are manufactured according to customer specifications, the customer must provide all necessary information and materials (“cooperation”).
The customer must ensure that such materials do not violate laws or third-party rights and that they hold the required usage rights.
The Seller is not obliged to verify legality.
The customer indemnifies the Seller against claims arising from such materials, including legal costs.
The Seller may refuse orders that violate legal provisions, third-party rights, or public decency.
11. Right of Withdrawal
Information on the right of withdrawal for consumers is provided in the Seller’s withdrawal policy.
